All information provided in this guide is subject to change and dependent on notification from the state. Please refer to the applicable Workers Compensation Statutes or Rules for additional information.

POC Timeliness Reporting Requirements |

NCCI’s received date is used to determine timeliness on POC transactions accepted by the state.

Policies |
Must be filed within 5 days after undertaking to insure an employer.
POC Notices may be submitted if the policy will not be issued within 5 days after undertaking to insure an employer. This does not eliminate the need to submit the policy.

Cancellations |
At least 30 days' notice shall be given by the insurance carrier to the employer and to the commission of any cancellation or nonrenewal of a policy if the cancellation or nonrenewal is at the election of the insurance carrier. The insurance carrier shall promptly notify the commission of any cancellation by the employer or failure of the employer to renew the policy.
Policies may not be cancelled by the insurer except for nonpayment or when one or both parties to a Professional Employer Organization agreement terminate the agreement.

Reinstatements |
Due within 5 days after the reinstatement.

Nonrenewals |

POC Data Reporting Requirements |
Data Elements:

Policy and Proof of Coverage (POC) Reporting Guidebook for all requirements
Address Reporting—No Physical Location:
- When there is no physical location in the state, Arizona will accept Employer Names linked to:
- Address Type 2—Location of Operations with an Out-of-State Address reported with State Code Link 02
- Arizona will not accept Employer Names linked to an Address Type 6—No Physical Location
State Processing Exceptions:
- Insurance companies writing workers compensation policies that use a Third Party Administrator (TPA) to process claims must register and provide the TPA contact information to the Industrial Commission of Arizona within 5 days of reporting the policy to NCCI.

POC Fines |
Possible Bad Faith Patterns and Practices fine of $1,000 for each incident if coverage provider and/or processing Third Party Administrator (TPA) are consistently reporting late, which results in delay of benefits.

Appeals |
May appeal fines to the Industrial Commission of Arizona.
