NCCI’s Residual Market Expiration List (RMEL®) promotes the depopulation of the
state assigned risk plans. Our goal is to help assist employers to obtain coverage
in the voluntary market. Rates are generally higher in the residual market; therefore,
it is in the best interests of the producer to help find coverage for the employer
in the voluntary market. NCCI's Residual Market Expiration List provides an additional
source for producers and employers to secure voluntary workers compensation insurance.
NCCI’s Residual Market Expiration List shows the residual market policies that will
expire within the next calendar year in a particular state.
NCCI’s Residual Market Expiration List is intended to be used solely to remove policyholders
from the residual market and place them in the voluntary market. All other uses
are strictly prohibited.
You agree and understand that for purposes of your access to and use of RMEL®, you
shall not be, nor construed or considered as, acting for or on behalf of, or as
a representative or agent of, NCCI as Plan Administrator, NCCI Holdings, Inc., its
agents, directors, officers or employees or any of its subsidiaries and/or any assigned
carrier for WCIP business. You further agree and understand that your access to
and use of RMEL® shall not be deemed to create an agency, partnership, joint venture
or employer and employee relationship between NCCI as Plan Administrator, NCCI Holdings,
Inc., its agents, directors, officers or employees or any of its subsidiaries and/or
any assigned carrier for WCIP business.
You may not copy, distribute, display, perform, recast, adapt, create derivatives
of, or modify RMEL® (produced electronically or otherwise) as provided, nor distribute,
rent, sublicense, transfer or lease RMEL®, except and unless expressly authorized
by NCCI in writing. Users are granted the limited right to copy and use in their
internal business operations the information or materials provided in connection
with RMEL®, provided that user does not remove any copyright, trademark or other
proprietary legend contained on such information or materials and only for the limited
purpose of offering, providing, writing and/or maintaining voluntary workers compensation
and employers liability insurance to producers and/or employers that have coverage
under NCCI’s Workers Compensation Insurance Plan (WCIP).
Your access to RMEL® is determined solely by NCCI. Notwithstanding any provision
in these Terms and Conditions, you further understand and agree that their your
access to and use of RMEL® may be withdrawn or terminated by NCCI in its sole discretion
at any time and/or for any reason without prior notice.
You acknowledge NCCI’s right, title, and interest in and to the copyright and other
commercial and proprietary rights provided by law to all programs, publications,
plans, systems, products, services or materials produced and/or provided by NCCI
in the performance of these Terms and Conditions.
You acknowledge the confidential and proprietary nature of any data or information
viewed or obtained pursuant to these Terms and Conditions. You agree to keep and
treat any data or information accessed and/or used through RMEL® confidential and
shall not disclose such data or information to any third party unless (1) authorized
by NCCI; or (2) such data or information is within or later falls within the public
domain, without breach of these Terms and Conditions; or (3) such data or information
is required to be disclosed pursuant to a valid subpoena or order of a court or
other governmental or regulatory body or any political subdivision thereof, provided
NCCI is promptly notified by the party receiving such subpoena or order in order
to allow NCCI to seek appropriate legal remedies, including but not limited to,
obtaining a protective order to prevent the release of disclosure of such confidential
and/or proprietary data or information.
Except as expressly set forth in these Terms and Conditions, you may not utilize
RMEL® for any other purpose, including but not limited to, benchmarking, report
generation, analysis, creation of a database, marketing, or any other commercial
or noncommercial use. You may not (or instruct others to) copy, distribute, create
derivatives, perform, display, lease, provide access to, or otherwise use any data
or information provided by NCCI, in whole or in part, in any media.
Additionally, you may not share, transfer, disclose or otherwise provide any passwords
or user identification numbers utilized to gain access to RMEL® to any third party
without the express written permission of NCCI.
You acknowledge and agree that use of RMEL®, including without limitation, the use
of private and public telephone lines, and linking to ncci.com through the World
Wide Web, may be subject to interruptions, delays, and disruptions that are beyond
NCCI’s control. NCCI is not responsible in any way for any non-NCCI products or
services advertised and/or made available through your Internet service provider
or the World Wide Web.
You are responsible for providing all computers, telecommunication equipment, and
other devices including Web browser software and Internet service provider access
necessary to access RMEL®. All associated fees, charges, costs, or expenses incurred
by you in connecting with RMEL® are your sole responsibility. You are also responsible
for assuring that your respective systems are capable of accessing RMEL®. In the
event any modifications or upgrades are required to your systems, you will have
sole responsibility for such upgrades or modifications.
