How NCCI Provides POC Data to State | - IAIABC POC 2.1 Format

Proof of Coverage Inquiry
Note: Carriers shall contact the New Hampshire DOL to be assigned a Carrier Identification Number prior to reporting workers compensation coverage for the first time. |
POC Timeliness Reporting Requirements |
Transaction Received Date | New Hampshire does not recognize NCCI's received date. The received date is determined by header date of the EDI file. |
Policies | Must be filed within 10 days after the Policy Effective Date. POC Notices may be submitted if the policy is not issued within 10 days after the Policy Effective Date. This does not eliminate the need to submit the full policy. The full policy is
required within 30 days after a POC Notice is submitted. If the policy is not received within the 30-day period, a penalty letter will be generated for all employers listed on the POC Notice. |
Cancellations | Must be filed 45 or more days prior to the Cancellation Effective Date or 30 days if for Nonpayment or Revocation of Voluntary Market. |
Reinstatements | Reinstatements must be sent before the 30 or 45 days after sending a termination. |
Nonrenewals | New Hampshire is a continuous coverage state. Nonrenewals are required and must be reported 45 days prior to the effective date of the nonrenewal cancellation. |
POC Data Reporting Requirements |
Data Elements: -
Industry Code—Prefers a valid North American Industry Classification System (NAICS) code (2002, 2007, 2012, or 2022 codes)
- Refer to the POC Data Element Requirements Chart located in NCCI’s
Policy and Proof of Coverage (POC) Reporting Guidebook for all requirements
Address Reporting—No Physical Location: - If you report a New Hampshire State Premium Record, you must report at least one New Hampshire employer address Type 2 or 6 linked to State Code Link 28
- When there is no physical location in the state, New Hampshire will accept Employer Names linked to:
- Address Type 6—No Physical Location
- Address Type 2—Location of Operations with an Out-of-State Address reported with State Code Link 28
State Processing Exceptions: - The New Hampshire Department of Labor does not currently acknowledge the IAIABC POC data, so no IAIABC reports will be available.
- If an employer is reported on a POC Notice but not reported on the full policy, the employer should be deleted from the POC Notice prior to the policy being reported (to avoid open coverage in New Hampshire for that employer).
- POC Notices on renewals are not necessary because New Hampshire is a continuous coverage state. However, if new employers are being added to the policy at the time of renewal, a POC Notice needs to be created for those employers (to avoid late filing penalties for those employers). When the renewal policy is reported, all employers must be reported.
- If a New Hampshire employer is not going to be reported on a renewal policy, the employer should be deleted from the original policy as of the original Policy Expiration Date.

POC Penalties & Appeals |
POC Fines | An insurance carrier that insures an employer and fails to file within a reasonable period of time will be assessed a civil penalty of up to $50 a day of noncompliance, beginning the date of written notification to the carrier. Penalties are per employer, not per policy. |
Appeals | Appeals may be filed with the New Hampshire Department of Labor. |
