As a POC service provider NCCI’s approach is to provide guidance to carriers on proof of coverage reporting guidelines. This guide is not intended to provide carrier notice to insured filing requirements.

All information provided in this guide is subject to change and dependent on notification from the state. Please refer to the applicable Workers Compensation Statutes or Rules for additional information.

How NCCI Provides POC Data to State

POC Timeliness Reporting Requirements
Transaction Received Date

NCCI’s received date is used to determine timeliness on POC transactions accepted by the state.

Policies

Due within 45 days after the Policy Effective Date.

POC Notices may be submitted if the policy will not be issued within 45 days after the Policy Effective Date. This does not eliminate the need to submit the policy.

Cancellations

Cancellation by Insurer

  • If the insurer cancels the insurance policy for nonpayment of premium, the Notice of Cancellation shall be filed at least 10 days before the effective date of the cancellation, in compliance with Insurance Article, IN §19-406(g), Annotated Code of Maryland.
  • If the insurer cancels the insurance policy for any other reason, the Notice of Cancellation shall be filed at least 45 days before the effective date of the cancellation, in compliance with Insurance Article, IN §19-406(b), Annotated Code of Maryland.

Cancellation by Insured

When the cancellation is initiated by the insured, the Notice of Cancellation shall be filed by the insurer within 15 days after the effective date of the cancellation.

New Policies After 45-day Underwriting Period or Renewal Policies— Cancellations are due no less than 45 days prior to the Cancellation Effective Date unless cancelled due to nonpayment of premium. Cancellations because of nonpayment of premium are due 10 days prior to the Cancellation Effective Date.

Reinstatements

Due within 15 days after the Reinstatement Effective Date.

Nonrenewals

Maryland is a continuous coverage state. Nonrenewals are required and must be reported no less than 45 days prior to the effective date of the nonrenewal cancellation.

POC Data Reporting Requirements

Data Elements:

  • Refer to the POC Data Element Requirements Chart located in NCCI’s Policy and Proof of Coverage (POC) Reporting Guidebook for all requirements

Address Reporting—No Physical Location:

  • When there is no physical location in the state, Maryland will accept Employer Names linked to:
    • Address Type 6—No Physical Location
    • Maryland will not accept Employer Names linked to an Address Type 2—Location of Operations with an Out-of-State Address

State Processing Exceptions:

  • None
POC Penalties & Appeals
POC Fines

The amount of $300 is assessed per occurrence for late reporting. If the fine is not paid within 60 days, the case is sent to a collection agency, and a $51 collection fee is added (which is strictly enforced). Currently, no fines are assessed for missing data.

Appeals

Appeals must be filed with the state within two weeks from the date of the fine notice.
