(For reference only. Not to be used for classification of risks for workers compensation purposes.)

236116—New Multifamily Housing Construction (except Operative Builders)

Description:

When all of the carpentry work in connection with the construction of a private residence is performed by employees of the same contractor, the work is assigned to Code 5645. This includes the construction and erection of the sill, rough framework, rough floor, studs, joists, rafters, roof deck, all types of roofing materials, sidewall sheathing, siding, doors, wallboard installation, lathing, windows, stairs, finished flooring, cabinet installation, fencing, decking and all interior wood trim.

Carpentry repair or remodeling of private residences is also assigned to Code 5645. To qualify for Code 5645, carpentry repair or remodeling operations of an interior or exterior nature must take place along with some framing or structural carpentry renovation of the premises that would ordinarily be assigned to Code 5645. When these conditions occur, the insured is performing operations that are analogous to the construction of a private residence, and Code 5645 is assigned to all carpentry operations in connection with the repair or renovation project. Merely performing singular operations such as repairing or replacing cabinets or installing wallboard does not constitute work to be classified to Code 5645. These singular repair operations are assigned to the appropriate classifications representing their specific trades. However, when activities of this nature take place in connection with operations that involve some framing or structural renovation of the dwelling, Code 5645 must be assigned to these specialty operations.

Code 5645 must be applied to the installation of cabinets or interior trim carpentry work in lieu of Code 5437—Carpentry—Installation of Cabinet Work or Interior Trim when employees of the same carpentry contractor perform any other carpentry operations at the same job or location.

Code 5645 is also assigned to carpentry operations on residential structures in connection with building raising or moving operations. When no separation of payroll exists, the payroll for the entire building raising or moving operation must be assigned to Code 5703 or the highest rated classification applicable, whichever is greater.

Special Conditions:

Extra-Territorial Classification Guidelines [ ___ ]:

The following material was developed by NCCI to be used as a guide by auditors and underwriters in the determination of premium for contracting (construction risks) with extra-territorial employments where no company guidelines have been established for this purpose. Construction classifications are indicated by the addition of a construction code symbol ( • ) next to the classification code number.

1.

Payroll of employees of contractors who have their place of business in a given state and operate also in adjoining states and who are constantly crossing state lines, but usually return to their homes each night, must be assigned to their headquarters’ state. Example: Contractors such as electricians, plumbers, carpet layers, etc.

2.

The payroll for construction project managers, executives, or superintendents who may visit a job but who are not in direct charge of a job must be assigned to the state in which their headquarters are located.

3.

There are contractors who maintain a permanent staff of employees and superintendents. If any of these employees or superintendents are assigned to a job that is located in a state other than their headquarters’ state, either for the duration of the job or any portion thereof, their payroll must be assigned to the highest rated of either the state in which the job is located or the headquarters’ state.

4.

The payroll of employees who are hired for a specific job project must be assigned to the state in which the job is located.

When a portion of the operations of a risk is insured in a monopolistic state fund, consider the special rules and requirements that may exist in such cases.
