5545  State Special: applies in MA, NY, WI

PHRASEOLOGY  MA—ROOFING NOC & YARD EMPLOYEES, DRIVERS

NY—ROOFING NOC & DRIVERS—INCLUDES YARD EMPLOYEES

WI—ROOFER: SHINGLE APPLICATORS ON NEW RESIDENTIAL CONSTRUCTION OF DETACHED PRIVATE RESIDENCES—ALL OPERATIONS & DRIVERS.

Applies to residences for occupancy by one or two families and private garages in connection therewith.

SCOPE  MA—Code 5545 applies to all types of work on sloped roofs having a pitch greater than three inches to the foot. No distinction is made between the materials used in the roofing process, which may include cold composition material such as asphalt shingles, metal, slate, tile or paper. Code 5545 is also applied to waterproofing operations when performed on roofs, insulation of roofs, and the installation of decks made of composition planks and tiles.

This code is applied to new roof installations as well as to the repair of roofs and includes driver and storage facility employees whether at the job site or at a separate location. Since Code 5545 includes yard or storage employees, Code 8227 is not available for division of payroll for roofers who maintain a permanent yard. This classification is also applicable to the pressure washing of roofs to remove moss, mildew or debris, and to the incidental replacement of worn or damaged roofing material.

Roofing work is not assigned to Code 5545 under the following conditions:

When all of the carpentry work in connection with the construction of detached dwellings, dwellings three stories or less, or commercial structures and/or dwellings exceeding three stories, is performed by employees of the same contractor, roofing work at these sites performed by employees of the same contractor is assigned to the appropriate carpentry code: Codes 5403, 5645, or 5651.

In addition, roofing on "Quonset" type buildings of the curved metal type is assigned to Code 5538 due to the fact that there is no distinction between the sides and the roof (a continuous curve).

With exception of the noted special classification procedure applied in the construction of Quonset-type structures, the application of Code 5538 to insureds engaged in roofing operations is limited and highly restrictive. Sheet metal shop fabrication operations conducted by roofing contractors qualify for assignment to Code 5538, and providing the proper payroll breakdowns are maintained, an individual's payroll may be allocated between Codes 5538, 5545, and 5547 for such shop fabrication. However, installation operations do not qualify for assignment to Code 5538 on any jobs that are properly assigned to Code 5545, regardless of what the specific sheet metal product being installed may be—flashing, skylights, or gutters and downspouts. Additionally, the installation of sheet metal flashing, etc., on built-up roofs, which is assignable to Code 5547, does not qualify for assignment to Code 5538 unless installed by a separate crew that is not engaged in any roofing at a built-up roofing job or location. The installation of sheet metal roofing panels is considered to be an integral part of the roofing installation job and does not qualify under any circumstances for assignment to Code 5538.

Please refer to Code 5403 for extra-territorial premium determination guidelines that may be applicable to insureds that have operations outside their headquarters' state.

NY—The scope for this classification is reflected in this state's phraseology for this code.

WI—Code 5545 is applied to insureds engaged in the installation of shingles on new residential construction. Reroofing, such as tear-offs or go-overs to be assigned to Code 5551.
