238350—Finish Carpentry Contractors

Description:

Code 5437 is intended primarily for specialist contractors performing interior carpentry finish or trim such as the installation of paneling, molding, cornices, parquet or finished wooden flooring, mantels, staircases, cabinets, and counters. Carpentry of this kind generally involves skilled workmanship.

“Crews,” in addition to employees of the contractor, include uninsured subcontractors and/or their employees when required by law to be covered under the hiring contractor’s workers compensation policy.

Door installations by specialists that involve a great degree of finish work are also included in Code 5437. The “specialist” will generally be required to cut the door to the proper size to fit the existing framework, perhaps do some routing for any interlocking weather-stripping or safety strips, and drill holes for the doorknob, hinges and striker plates.

No rough carpentry work is included under this classification.

The following material was developed by NCCI to be used as a guide by auditors and underwriters in the determination of premium for contracting (construction or erection risks) with extra-territorial employments where no company guidelines have been established for this purpose. Construction or erection classifications are indicated by the addition of a construction code symbol () next to the classification code number.

Payroll of employees of contractors who have their place of business in a given state and operate also in adjoining states and who are constantly crossing state lines, but usually return to their homes each night, should be assigned to their headquarters’ state. Example: Contractors such as electricians, plumbers, carpet layers, etc.

2.   

The payroll for executive supervisors who may visit a job but who are not in direct charge of a job should be assigned to the state in which their headquarters are located.

3.   

There are contractors who maintain a permanent staff of employees and superintendents. If any of these employees or superintendents are assigned to a job that is located in a state other than their headquarters’ state, either for the duration of the job or any portion thereof, their payroll should be assigned to the highest rated of either the state in which the job is located or the headquarters’ state.

4.   

The payroll of employees who are hired for a specific job project should be assigned to the state in which the job is located.

When a portion of the operations of a risk are insured in a monopolistic state fund, consideration must be given to the special rules and requirements that may exist in such cases.

Related Operations Not Classified to Code 5437:

Code 5437 is not applicable to contractors who perform other carpentry operations at the same job or location. If the carpentry contractor is also engaged in other carpentry operations in addition to interior carpentry work (described above) at the same job or location, the entire carpentry payroll must be assigned to the applicable carpentry construction classification. This procedure is true regardless of any time lapse between the two types of work or if the different types of carpentry work were performed by different crews employed by the same contractor. For purposes of this interpretation, operations assigned to Code 5445—Wallboard Installation Within Buildings are considered other carpentry.

The installation of wood flooring requires cutting, sanding, drilling, and attaching using nails, screws, or pegs. Refer to Code 5478 for laminate wood flooring such as engineered wood flooring installed using glue-down or interlocking methods. Not applicable to contractors who perform any other carpentry operations at the same job or location.

Description:

The installation, sanding, or scraping of wood floors is assigned to Code 5437. The installation of wood floors requires cutting, sanding, drilling, and attaching using nails, screws, or pegs.
