PHRASEOLOGY  CARPENTRY—INSTALLATION OF CABINET WORK OR INTERIOR TRIM.

Not applicable to contractors who perform any other carpentry operations at the same job or location.

CROSS-REF.  Carpentry—Installation of Finished Wooden Flooring—includes installation of parquet flooring. Not applicable to contractors who perform any other carpentry operations at the same job or location; Floor Sanding or Scraping—Wood Floors.

State Special: Hawaii, Oregon, South Dakota—Code 5437 footnotes do not contain the following restrictive phrase, "Not applicable to contractors who perform any other carpentry operations at the same job or location";

Massachusetts—Carpentry—Installation of Cabinet Works or Interior Trim—not applicable to the installation of interior carpentry other than cabinet work or trim. Structural or other carpentry installation shall be separately rated as Code 5403—Carpentry NOC whether performed by the same or a different concern. Unless the payroll records are accurately maintained showing the amount of payroll expended for cabinet work or interior trim installation, the entire payroll representing all carpentry work for the job shall be separately rated as Code 5403—Carpentry NOC. Codes 5645—Carpentry, etc., and 5651—Carpentry—Dwellings, etc., shall not be assigned at the same job or location to which Code 5437 applies;

New Jersey—Carpentry—Installation of Finished Wooden Flooring—includes installation of parquet flooring. Not applicable to risks engaged in any other carpentry operations. May be used only upon specific approval of the rating bureau;

New Jersey—Floor Scraping or Finishing;

New Jersey—Weatherstripping;

Oregon—the following carpentry note, indicated in the Oregon Basic Manual pages, is considered part of this state's phraseology for Code 5437: Note 1. Installation of cabinet work, interior trim, finished wooden floors including parquet flooring, to be separately rated from other carpentry codes as Code 5437;

South Dakota—add the following footnote to the above phraseology: The installation of cabinet work and interior trim is separately rated from other carpentry classifications as Code 5437.

SCOPE  Code 5437 is intended primarily for specialist contractors performing interior carpentry finish or trim such as the installation of paneling, molding, cornices, parquet or finished wooden flooring, mantels, staircases, cabinets and counters. Carpentry of this kind generally involves skilled workmanship.

Code 5437 is not applicable to contractors who perform other carpentry operations at the same job or location. If the carpentry contractor is also engaged in other carpentry operations in addition to interior carpentry work (described above) at the same job or location, then the entire carpentry payroll must be assigned to the applicable carpentry construction classification. This procedure is true regardless of any time lapse between the two types of work or if the different types of carpentry work were performed by different crews employed by the same contractor. For purposes of this interpretation, operations assigned to Code 5445—Wallboard Installation Within Buildings are considered other carpentry.

"Crews," in addition to employees of the contractor, include uninsured subcontractors and/or their employees when required by law to be covered under the hiring contractor's workers compensation policy.

Door installations by specialists that involve a great degree of finish work are also contemplated by Code 5437. The "specialist" will generally be required to cut the door to the proper size to fit the existing framework, perhaps do some routing for any interlocking weather-stripping or safety strips and drill holes for the doorknob, hinges and striker plates.

Additional operations, which are assigned to this classification by analogy, include the installation of locks in new buildings, the sanding or scraping of wooden floors and the installation of weather stripping.

No rough carpentry work is contemplated under this classification.

Please refer to Code 5403 for extra-territorial premium determination guidelines that may be applicable to insureds that have operations outside their headquarters' state.

State Addendum
Massachusetts —as noted in Code 5437's footnotes regarding the installation of cabinet work/interior trim and finished wooden flooring, Code 5437 is not available for assignment to contractors who perform other carpentry operations at the same job or locations to which Codes 5645 or 5651 applies. Consistent with its restrictive footnotes, Code 5437 is, however, available for assignment to contractors who perform other carpentry operations at the same job or locations to which Code 5403 applies. Refer to Code 8010, which is assigned by analogy, for specialist contractors engaged exclusively in the installation of locks in new buildings.
